The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Shivsagar (Baddi OP) P.S. Case no. 144 of 2021 instituted for the offence under Sections 307, 323, 223, 254(A), 341, 379, 504, 506, 147, 149 of the Indian Penal Code.

It is a case of assaulting to the informant's brother and his uncle due to which they sustained injuries. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has got no criminal antecedent. It is further subitted that there is case counter case between the parties. General and omnibus allegation leveled against the petitioners. Similarly

Patna High Court CR. MISC. No.39952 of 2022(2) dt.06-12-2022 2/2 situated co-accused namely, Bharat Bind has been granted anticipatory bail vide order dated 11.10.2022 in Cr. Misc. No. 24575 of 2022.

Learned APP appearing for the state has opposed the prayer of anticipatory bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Shivsagar (Baddi OP) P.S. Case no. 144 of 2021, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Rohtas at Sasaram subject to the conditions as laid down under section 438(2) of the Cr.P.C.
