JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-08-2019 This is an application for grant of anticipatory bail in connection with Belaganj P.S. Case No. 320 of 2018, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Prosecution case is that police on information that petitioner and other accused persons are engaged in manufacturing of the liquor, raided the place of occurrence, accused persons on seeing the police party, they have succeeded in fleeing away and further it appears that 10 liters of illicit liquor has been recovered from the hut of Nanhak Paswan. Apart from that several other articles were also recovered, which were used in manufacturing the liquor and the petitioner is named in the F.I.R.
Submission of the learned counsel for the petitioner is
Patna High Court CR. MISC. No.35485 of 2019(3) dt.09-08-2019 2/2 that except that he is named in the F.I.R., nothing against him, having no criminal antecedent.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Excise Judge, Gaya, in connection with Belaganj P.S. Case No. 320 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
