JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147/148/149/341/323/353/307/386/387/330/467/120B of the Indian Penal Code.

It is alleged that the informant being the BDO of Chakiya block was surrounded by mob led by Raghunath Sah and Bhola Prasad as they were alleging the partition attitude adopted by the informant during the PACs elections, when the informant made protest the accused persons assaulted him whereas co-accused Raghunath Sah and Bhola Prasad tried to strangulate and snatched gold chain, ring, two mobile sets. It is also alleged that from the mob some one was addressing the petitioner and others to assault.

It is submitted by learned counsel for the petitioner

Patna High Court Cr.Misc. No.19640 of 2015 (2) dt.29-04-2015 2/2 that the accusation is not specific against the petitioner and on suspicion only the petitioner has been dragged in the present case. The injury has been found simple in nature. It is further submitted that the petitioner has strained relationship with the informant since the informant failed to comply the order passed in CWJC No. 16554 of 2014 field by the petitioner with regard to PACs elections.

Considering the accusation against the mob and the specific accusation levelled against Raghunath Sah and Bhola Prasad, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Pipra P.S. Case No.270 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
