This application is for grant of regular bail in connection with Ujiyarpur P.S.Case No.08 of 2016 for the offences under Sections 341, 386, 307 & 34 of the Indian Penal Code and Seciton 3⁄4 of Explosive Substance Act.

Allegation against the petitioner and other accused persons is that they came on the Tea Shop where the informant was taking tea and co-accused, Dhananjay Issar demanded Rs.5,00,000/- as extortion and also A.K. 47 Rifle was put on his chest, thereafter, the other accused persons thrown bomb but that did not explode. It is submitted on behalf of the petitioner that no specific allegation has been attributed against the petitioner and he has been falsely implicated in this case. The petitioner is in custody

Patna High Court Cr.Misc. No.17027 of 2017 (5) dt.17-05-2017 2/2 for about five months. So far criminal antecedent of the petitioner is concerned, it has been submitted that the petitioner has been arrested in one case after another and he has been remanded in three other cases.

Heard learned A.P.P. also, who has opposed the prayer for bail.

Having heard both sides and in view of allegation, I am not inclined to grant bail to the petitioner, however, the petitioner may renew his prayer for bail after framing of charge in this case. With the aforesaid observation, this application is dismissed.
