JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-03-2015 Heard learned counsels for the petitioner and the State. The petitioner being husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 498A/34 and 494 of the Indian Penal Code.
The basic accusation is of torture for non fulfillment of dowry demands.
It is submitted by the learned counsel for the petitioner that earlier Complaint Case No. 192 of 2012 was filed with similar accusation. Consequently, the petitioner made payment of Rupees two lacs, thereafter the petitioner was granted anticipatory bail by the learned court below. Statement has been made in paragraph 16 of the petition that the petitioner is still ready to keep and maintain

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi in connection with Sitamarhi Mahila P.S. Case No. 23 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
In case the informant files an application for resuming the conjugal life, the learned court will issue notice to the petitioner and the petitioner will be obliged to comply the undertaking given before this court.
