The petitioners apprehend their arrest in Nasriganj (Rajpur) P.S. Case No. 17 of 2015, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.

The informant alleged that Udai Singh was removing the bricks stacked by the side of the building. Umesh Singh enquired about reason, on such Udai Singh, Chandan Singh assaulted Umesh Singh with Pharsa and sticks respectively. Vijay Singh also assaulted with Lathi. The informant also got injuries. It is submitted that Umesh Singh got one lacerated

Patna High Court Cr.Misc. No.19086 of 2015 (3) dt.03-07-2015 2/2 wound on head and another sharp cut injury on the thigh. The dimension of sharp cut injury on thigh appears to be superficial. The nature of injury found on the head is not brought on record till 03.06.2015, as the diary is submitted till that date. Manoj Singh also got two injuries which are opined to be simple in nature. There is Title Suit No. 26 of 2014, pending between the petitioner Udai Singh and others in which Ramesh Singh father of the informant is defendant no. 2.

Considering the facts aforesaid and the fact that the occurrence took place due to land dispute and the injuries appears to be simple in nature, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Basant Kumar, the learned Judicial Magistrate, 1st Class-cum-Additional Munsif-2, Bikramganj, Rohtas in Nasriganj (Rajpur) P.S. Case No. 17 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
