JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-08-2019 This application, for grant of anticipatory bail, arises out of Vishnupad P.S. Case No. 216/2018, disclosing offences under Sections 448, 341, 323, 307, 324, 379, 504 and 34 of the Indian Penal Code.
Allegation against the petitioner and others is that they came to the house of informant and assaulted him as well as his parents and this petitioner is said to have given knife blow to the informant causing injury on his neck and accused person also snatched away ear ring worth Rs. 16,000/- Submission of learned counsel for the petitioner is that there is case and counter case between the parties in the background of land dispute and although, there is allegation of assault, however, the injuries sustained by the informant and his

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Vishnupad P.S. Case No. 216/2018, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
