JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-10-2017 Heard learned counsel for the petitioner and the State as well as Mr. Rajesh Prasad Choudhary appearing on behalf of Veer Kunwar Singh University.

The claim of the petitioner in the instant writ petition is for payment of retiral dues of the petitioner who superannuated on attaining age of superannuation on 31st of July, 2014 as 'Reader' from S.N. College Shahmal Khairadeo P.S. Kargahar District Rohatas at Sasram.

In the counter affidavit filed on behalf of the Veer

Patna High Court CWJC No.3106 of 2016 (6) dt.06-10-2017 2/2 Kunwar Singh University wherein a statement has been made in para-6 and 7 that a three men committee was constituted to examine the claim of the petitioner under Rule 43 (b) of Bihar Pension Rules and also to examine the claim of payment of subsistence allowance.

The affidavit further goes to show that after submission of report by the three men committee, the University will take steps for payment of admissible dues. In view of averment made in para-6 and 7 of the counter affidavit, the application is disposed of with a direction to the University to take final decision on the report of the three men committee, if not already taken and if the petitioner is found entitled to payment the same should be paid to him within four months from the date of decision on the report of 3 men committee discussed above. With the aforesaid observation, the application stands disposed of.
