The petitioner is apprehending his arrest in connection with Makhdumpur P.S.Case No.103 of 2018 registered for offences punishable under Sections 420, 467, 471, 120(B) of the Indian Penal Code and Section 30(c) of the Bihar Excise and Provisions Act, 2016..

As per FIR there is allegation that the police got information that huge quantity of liquor was being carried in a container. It further appears that on that information the police intercepted the container bearing registration no.HR 55AB 5341 along with Tavera and Bolero vehicle and seeing the police party the accused persons started fleeing away. There is further allegation that more than 1400 ltrs. of foreign liquor was recovered which was Haryana-made.

No.37998 of 2019(3) dt.20-09-2019 2/2 Submission of the learned counsel for the petitioner is that he is owner of the vehicle and he has falsely been implicated in this case and earlier to that he had executed an agreement with one Bijendra Kumar, Transporter for using the truck, which will appear from annexure 2 and thereafter the truck was intercepted.

Heard learned A.P.P. , who has opposed the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction tot he petitioner to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court and if possible to be disposed of on the same day.

With the aforesaid direction, this application is disposed of.
