2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 7 of EC Act.

3. As per the prosecution case, during inspection certain irregularities in distribution of food grains and shortage of 216.22 kg of wheat and 548.49 of rice was found in the then remaining stock of the shop of the petitioner.

4. Learned counsel for the petitioner submits that as per the oral order of the District Administration through State that during period of Corona pandemic that each and every beneficiary will be given ration without any document or finger print. So, this petitioner distributed the food grains among the beneficiaries but due to defect in the POSH machine the records

Patna High Court CR. MISC. No.45167 of 2024(2) dt.29-07-2024 2/2 were not maintained properly. Moreover, the license of the petitioner has already been cancelled. Petitioner claims clean antecedents.

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Araria in connection with Narpatganj ( Bathnaha) P.S. case No. 02 of 2024 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
