Petitioners seek bail in Kajra P.S. Case No.67 of 2018 instituted for the offence under Section(s) 272, 273, 290 Indian Penal Code and Sections 30(a) and 41(i) of Bihar Prohibition and Excise Act, 2016.
Counsel for the petitioners submits that from the seizure list it will appear that seizure of illicit liquor has been made from behind Narottampur High School. There is no recovery of illicit liquor from conscious possession of the petitioner.
It is alleged that petitioner No.1 and 2 were driving motorcycles. From the dickey of those motorcycles, 45 litres
Patna High Court CR. MISC. No.37610 of 2019(2) dt.25-06-2019 2/2 and 5 litres respectively country made liquor have been recovered.
Petitioners are in custody since 02.04.2019 having clean antecedents.
In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the ADJ II cum Special Judge, Excise, Lakhisarai, in connection with Kajra P.S. Case No.67 of 2018, subject to the condition that both the bailors shall be close relative of the petitioners.
