The petitioner, who is in custody since 15.07.2020 seeks bail in connection with Excise Case No. 168 of 2020 instituted for the offence under Section 30(a) of the Bihar Prohibition and Amendment Excise Act, 2018.

From the prosecution report, it appears that 164.280 litres of liquor was recovered from a vehicle of which the petitioner is stated to be the driver. The petitioner has denied that he is the driver of

Patna High Court CR. MISC. No.36485 of 2020(2) dt.30-01-2021 2/2 the vehicle from where recovery has been made. He was only a gratuitous passenger in the aforesaid vehicle. The petitioner has clean antecedents.

Considering all these facts, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II-cum-Special Judge, Excise, Gopalganj, in connection with Excise Case No. 168 of 2020.
