JUSTICE SANJAY PRIYA ORAL ORDER 21-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seek bail in Complaint Case No. C2450 of 2016 instituted for the offence under sections 30(a) of Bihar Excise Amendment Act.

It is alleged that total 654 pieces of Nepali wine each of 300 ml. has been recovered from joint possession of three accused persons.

The seizure list has been enclosed with the written report which does not bear signature of this petitioner. It has been submitted that the petitioner is in custody since 31.12.2016 and he has clean antecedent. Considering the aforesaid facts and circumstances, the prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.11116 of 2017 (2) dt.21-03-2017 2/2 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Complaint Case No. C2-450 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
