JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-09-2019 This is an application for grant of anticipatory bail in connection with Supaul Mahila P. S. Case No. 106 of 2018, disclosing offences under Sections 341, 447, 448, 452, 365, 354A, 323, 379, 504, 506, 34 of the Indian Penal Code. Prosecution case is that petitioner and other accused persons entered inside the house of the informant and tied her with rope and started outraging her modesty and when the grandmother of the informant raise complain, they assaulted and also disrobe her.
Submission of the learned counsel for the petitioner is that there is delay in lodging the F.I.R. and the informant and petitioner are co-sharers and no specific allegation has been attributed against him. Further submission is that one of the witness has also stated before the police the fact that she came

Heard learned A.P.P. as well as learned counsel for the opposite party no.2 also, they have opposed the prayer for anticipatory bail of the petitioner.
Having heard both sides, considering the above submission, this application is allowed. Provisional bail granted to the petitioner, vide order dated 21.06.2019 is confirmed. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
