Patna High Court CR. REV. No.1061 of 2014 (2) dt.28-02-2017 2/2 Judicial Magistrate, Nawada, has dismissed a complaint case filed by the petitioner for non-prosecution. From the order sheet, I find that on several occasions, when the complaint petition was posted for taking statement of the complainant on solemn affirmation, the complainant did not appear.
In such circumstance, the dismissal of the complaint case cannot be said to be unjustified. This application has no merit, which is accordingly dismissed.
