JUSTICE SUDHIR SINGH ORAL ORDER 21-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 147, 148, 149, 341, 323, 504, 506, 379, 307 and 302/34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping, snatching of golden chain and ring and cash amount of Rs.500 and assaulting the informant and other villagers, who came to rescue the informant.

It has been submitted on behalf of the petitioner that police has submitted chargesheet in which the petitioner has not been sent up for trial but the court below has differed with the said chargesheet and has taken cognizance against the petitioner. As per the F.I.R., specific allegation has been made against Kamlesh Singh, Pappu Singh and Gupteshwar Yadav.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts, let the above named

Patna High Court Cr.Misc. No.23473 of 2015 (3) dt.21-09-2015 2 / 2 petitioner, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri A. K. Singh, learned Judicial Magistrate, Ist Class, Bhabhua in connection with Bhabhua P.S. Case no. 189 of 2003, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
