JUSTICE BIRENDRA KUMAR ORAL ORDER 21-04-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Section 366A/34 of the Indian Penal Code.

FIR was lodged with allegation of kidnapping of daughter of the informant. The victim girl has given in writing to the police that she has voluntarily married with co-accused Raja Kumar. The petitioners are relatives of Raja Kumar. Considering the statement of victim girl, let the petitioners, above named, in the event of their arrest or surrender

Patna High Court Cr.Misc. No.9384 of 2017 (3) dt.21-04-2017 before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur/Successor Court in connection with Paroo P.S. Case No.249 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and subject to the further condition that petitioners shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioners in this case.
