The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 120B and 34 of the Indian Penal Code.
As per the prosecution case, information was received by the informant about two dead bodies having been found. On going to the place of occurrence the dead bodies of Bharat Sah and his wife were found in the house. It appeared that they had been murdered by unknown accused persons. It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The name of the petitioner transpired in course of investigation in the confessional statement of coaccused Mintu Pal and Mukesh Kumar Trivedi made before the police. Mintu Pal @ Pintu Pal
Patna High Court CR. MISC. No.48601 of 2021(4) dt.31-03-2022 2/2 has been enlarged on bail vide order dated 25.10.2018 passed in Cr.Misc. no. 53354 of 2018 and Mukesh Kumar Trivedi has been enlarged on bail vide order dated 1.11.12018 passed in Cr.Misc. no.57170 of 2018. The petitioner is in custody since 31.3.2021 and investigation in the case has concluded. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case, the material that has transpired in course of investigation, grant of bail to coaccused Mintu Pal and Mukesh Kumar Trivedi on whose confessional statement before the police the name of the petitioner transpired together with the chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Sitamarhi P.S. Case no. 373 of 2018 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magitrate, Sitamarhi.
