The petitioner apprehends his arrest in Siwan (Mufassil) P.S. Case No. 18 of 2015, registered for the offences punishable under Section 498A and other Sections of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act. The informant wife of the petitioner made allegation that after marriage the petitioner made further demand of dowry for purchasing a flat in Delhi. The petitioner subjected his wife to physical and mental torture. The informant also gave a birth to a child aged three years.
It is submitted that the wife is schizophrenic she always misbehaved with the petitioner. She left the house of the petitioner
Patna High Court Cr.Misc. No.18644 of 2015 (2) dt.06-05-2015 2/2 after leaving her daughter. The matter was reported to the concerned police station. The petitioner also filed divorce case in the court of Principal Judge, family court, Lucknow. Having considered the facts that there is allegation against the petitioner that he subjected his wife to physical and mental torture the petitioner being the husband is not ready to keep his wife, I am not inclined to enlarge the petitioner above named on anticipatory bail.
