Mr. Sanjay Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-09-2025 Heard learned counsel appearing on behalf of the petitioners and learned A.P.P. appearing on behalf of the State.

2. The petitioners seek bail in a case registered for the offence punishable under Sections 302, 120B and 34 of the Indian Penal Code.

3. As per prosecution case, it is alleged that all the F.I.R. named accused persons, including these petitioners, killed daughter of informant and thereafter, buried her dead body in a deep dig and sprinkled salt all around them.

4. It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have committed no offence. Petitioners have falsely been implicated in this case merely because Petitioner No. 1 happens to be mother-in-law and Petitioner No. 2 happens to he Gotni (sister-in-law) of the informant. Informant is not an eye witness of the allegation occurrence. Petitioners are victim of over implication. Thrust of accusation is against husband of the informant. Charge-sheet has already been submitted and petitioners are in custody since 22.01.2025. Petitioners claim clean antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners.

6. Considering the facts and circumstances of the case, clean antecedents of the petitioner and period of custody, the prayer for grant of bail to the petitioners is allowed.

7. Accordingly, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Raxaul at Motihari, East Champaran in connection with Ramgarhwa P.S. Case No. 118 of
