2. The petitioner seeks regular bail in connection with Desari P.S. (Sahdeai O.P.) Case No. 318 of 2023 lodged on 18.09.2023, for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 05.12.2024 passed in Cr. Misc. No. 75617 of 2024 with liberty granted to the petitioner that he may renew his prayer for bail six months after framing of charge. Counsel submits that the charge has already been framed in this case on 04.04.2025. Counsel further submits that the petitioner is in custody since 28.08.2024.
4. Learned APP for the State opposes the prayer for
Patna High Court CR. MISC. No.37726 of 2025(2) dt.27-06-2025 2/2 bail of the petitioner.
5. In the present facts and circumstances of this case, let the above named petitioner be granted bail as well as on being satisfied by the Trial Court that the petitioner is not absconding in any of the cases pending against him whose details are mentioned below, and on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the Bharatiya Nagarik Suraksha Sanhita, 2023 to the satisfaction of Exclusive Special Excise Court no.1-cumAdditional District & Sessions Judge, Vaishali at Hajipur in connection with Desari P.S. (Sahdeai O.P.) Case No. 318 of 2023, subject to the conditions as laid down U/s 480(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
6. Pending cases against the petitioner are as follows:- I. Mahua Excise P.S. Case No.90 of 2023 II. Rajapakar P.S. Case No.46 of 2019 III. Rajapakar P.S. Case No.74 of 2023 IV. Rajapakar P.S. Case No.32 of 2022.
