The petitioner is in custody since 27.08.2016 in connection with C2/234/2016 registered for an offence under Sections 47 (A) AND 53 (b) of Bihar Excise Act. The informant along with other armed forces apprehended the petitioner along with two others and 13.500 liter of Nepali Saufi wine was recovered from their joint possession. Learned counsel for the petitioner submits that the petitioner is in custody since 27.08.2016 and remaining two accused persons have already been allowed bail by the learned lower Court.

However, learned A.P.P. opposed the prayer for

Patna High Court Cr.Misc. No.10083 of 2017 (2) dt.08-03-2017 2/2 bail.

In the facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with C2/234/2016.
