JUSTICE BIRENDRA KUMAR ORAL ORDER 11-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 147/148/149/341/324/307 of the Indian Penal Code, Sections 25(1-B)a/26/27/35 of the Arms Act and Section 3/4 or the Explosive Substances Act. For old dispute the F.I.R. named accused persons and unknown persons started firing and hurling bomb, causing mild injury to the informant. The petitioner was apprehended thereafter his name appeared in the F.I.R.
Submission of the petitioner is that he was simply passerby, there is no other eyewitness, which is evident from the case-diary and there is no specific allegation against the petitioner.

No.9805 of 2017 (3) dt.11-04-2017 2/2 Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur/Successor Court, in connection with Jagdishpur P.S. Case No.239 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
