This is an application for bail in connection with Mahua P.S.Case No. 07 of 2017 registered for the offences punishable under Sections 30(A) of the Bihar Prohibition and Excise Act, 2016 and Section 414 of the Indian Penal Code. It has been submitted on behalf of the petitioner that petitioner is nowhere concern with the seized liquor and he is brother of accused Ramesh Kumar Rai and the recovery is from the said Ramesh Kumar Rai and he has nothing to do with the same and as he was standing there he was arrested along with the seized liquor and he is in custody since 9.1.2017. Heard learned APP also, who has opposed the prayer for bail.
Having heard both sides and in view of the fact that
Patna High Court Cr.Misc. No.9877 of 2017 (2) dt.01-03-2017 2/2 petitioner was also arrested at the spot and in the seizure list the name of the petitioner is mentioned and there is recovery of 1200 litres of liquor, I am not inclined to grant bail to the petitioner at this stage. However, petitioner may renew his prayer for bail after a period of six months.
Accordingly, this application is dismissed.
