ANJANA MISHRA ORAL ORDER 18-09-2015 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Aurangabad Town P.S. Case No.206 of 2014 for allegedly having committed the offence under Section 414 of the Indian Penal Code.

Learned counsel for the petitioners submits that the motorcycle alleged to have been recovered from the premises is neither the stolen motorcycle nor there has been any complaint with regard to theft of the motorcycle, bearing registration No.BR-26B-2729. It is further submitted that the motorcycle was owned by one Vikash Kumar, son of Sanjay Singh, who

Patna High Court Cr.Misc. No.18412 of 2015 (5) dt.18-09-2015 2/2 had transferred it to one Rakesh Kumar Singh. Subsequently, the said motorcycle was handed over to one Chandan Kumar Singh, who sold the same by means of valid papers to Anuj Singh. Thereafter, the said motorcycle was handed over to Manoj Singh, petitioner No.1 herein, by said Anuj Singh. Considering the aforementioned facts and circumstances and also that there is no report regarding theft of the aforementioned motorcycle, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad Town P.S. Case No.206 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
