====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-05-2022 Heard the learned counsel for the parties.

The petitioner, who is husband of the informant /wife and is in custody since 02.05.2021 seeks bail in connection with Daudpur P.S. Case No. 92 of 2021 instituted for the offences under Sections 341, 323, 324, 498(A), 504 and 506/34 of the Indian Penal Code and Section 3 /4 of the Dowry Prohibition Act.

The learned counsel for the petitioner has begun his argument by making a statement that the petitioner is ready and willing to take back his wife to her matrimonial fold and give to her all the privileges which a married women is entitled to. The learned counsel for the informant also submits that the wife is ready to go and join the petitioner as his wife

Patna High Court CR. MISC. No.49254 of 2021(2) dt.25-05-2022 2/2 provided the petitioner does not misbehave with her as he has done in the past.

Considering the afore-noted stand of the parties and taking into account the period of custody of the petitioner, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran, Chapra, in connection with Daudpur P.S. Case No. 92 of 2021.

Should the petitioner be found to be misbehaving with his wife/informant, it would be open for her to move for cancellation of his bail.
