JUSTICE SANDEEP KUMAR ORAL ORDER 07-01-2025 This is an application for quashing of the order dated 18.08.2018 passed in SC/ST P.S. Case No. 22 of 2017 passed by the learned Special Judge, Bhagalpur by which the court below has taken the cognizance of the offences under Sections 341, 323, 504, 506/34 of the Indian Penal Code and under Section 3(i)(r), 3(ii)(va) of the SC/ST Act.

2. The present case has been registered as counter blast of Kotwali P.S. Case No. 237 of 2017 registered under

Patna High Court CR. APP (SJ) No.2723 of 2019(12) dt.07-01-2025 2/2 Section 376, 420, 341, 323, 504, 506, 509 of the Indian Penal Code.

3. It has jointly been submitted by the learned counsel for the appellants and the learned counsel for the respondent no. 02; Md. Najmul Hodda that both the cases be quashed so that the parties may not fight in the future. They also submit that the parties do not want to proceed in the matter.

4. Considering the aforesaid, this application is allowed. Accordingly, the order dated 18.08.2018 passed in SC/ST P.S. Case No. 22 of 2017 by the learned Special Judge, Bhagalpur and the F.I.R. of Kotwali (Tilka Manjhi) P.S. Case No. 237 of 2017 are hereby quashed.
