The petitioners apprehend their arrest in Laukaha (Lalmaniya) P.S. Case No. 179/98, registered for the offences punishable under Sections 307 and other Sections of the Indian Penal Code.
The petitioners were laying foundation of boundary wall on the way of village and on protested by the informant, Laxmi Yadav (Petitioner no. 1) assaulted Dilip Yadav with Farsa. Petitioner no. 2 (Lalu Kumar @ Lalu Yadav) is alleged to have assaulted Sita Devi, Sunita Devi and other family members. There is a counter version bearing Laukaha (Lalmaniya) P.S. Case No.
Patna High Court Cr.Misc. No.19722 of 2015 (3) dt.02-07-2015 178/2014.
From perusal of the injury report of Dilip Yadav it appears that he got sharp cut injury on parietal area of scalp but the injury is simple in nature. Other persons from the side of the informant also got injured, but the injuries are simple in nature. Considering the facts aforesaid, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri D.N. Mishra, Judicial Magistrate 1st Class, Jhanjharpur in connection with Laukaha (Lalmaniya) P.S. Case No. 179/2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
