JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-05-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Garkha P.S.Case No. 161 of 2016 for the offences under Sections 341, 324, 307/34 of the Indian Penal Code.

The allegation against the petitioner is that he has given Chura blow to the informant on the order of co-accused Ram Raj Sharma allegedly for not casting vote in his favour. Co-accused Ram Raj Sharma, who has provided knife to the petitioner for committing offence has been granted anticipatory bail by a bench of this Court vide order dated 08.09.2016 in Cr. Misc.No.30124 of 2016 (Annexure 3). This petitioner is in custody since 21.09.2016. In para 3 of the petition a statement has been mentioned that the petitioner has no criminal antecedent and in para 13 of the petition

Patna High Court Cr.Misc. No.16136 of 2017 (4) dt.31-05-2017 2/2 it is also stated that the petitioner is a student of Ram Jaipal College,Chapra.

In view of the fact that the petitioner is in custody since 21.09.2016 and the statement made in para 3 that he has no criminal antecedent, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V,Saran,Chapra, in Garkha P.S.Case no. 161 of 2016 on the condition that he will extend full co-operation in the trial and he will not in any manner influence the evidence or the witnesses.
