====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-06-2026 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109(1), 308(3), 303(2), 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.

3. Prosecution case, in brief, is that on 10.03.2025 at about 9 PM, all the F.I.R. named accused persons, including this petitioner and 10-12 unknown miscreants, hurdled verbal abuses and assaulted informant and others by means of iron rod, pistol, fists and slaps. It is further alleged that the accused persons also snatched gold chain and cash.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Specific

Petitioner is only alleged to be member of the mob and there is no allegation of any specific overt act against him. Rest of the allegations are ornamental only to make the case grave. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering backdrop of the case, nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- 1st Jhanjharpur in connection with Jhanjharpur R.S. P. S. Case No. 20 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
