JUSTICE BIRENDRA KUMAR ORAL ORDER 11-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 376 of the Indian Penal Code. The allegation is of commission of rape against the informant. The parties have entered into compromise. Submission of the petitioner is that just to pressurize for some illegal extortion of money or to pressurize in earlier dispute, there is habit in the particular area of the State to lodge false cases and thereafter compromise the same. Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like

Patna High Court Cr.Misc. No.9827 of 2017 (3) dt.11-04-2017 2/2 amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar/Successor Court, in connection with Kodha P.S. Case No.187 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
