Petitioner is in custody in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 234 of 2019 for the offence under sections 302/120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent.

Learned counsel submits that only on suspicion, the petitioner and others have been made accused in the present case.

Learned counsel with reference to Annexure-2 series would submit that similarly circumstanced other co-accused have been granted bail by different benches of this Court.

No.36253 of 2020(3) dt.05-04-2021 2/2 Considering the fact that the petitioner has no criminal antecedent and similarly other co-accused has been granted bail , the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 234 of 2019.
