JUSTICE SUDHIR SINGH ORAL ORDER 17-05-2017 Heard learned counsel for the Petitioner and the State. The Petitioner seeks bail in S.T. No.261 of 2016 arising out of Khaira P.S. case No.67 of 2016 instituted for the offence under Sections 364, 302 and 120B/34 of the Indian Penal Code, pending in the court of learned Additional District and Sessions Judge III, Jamui.

The earlier bail application of the petitioner was rejected vide Annexure-1 to the present application relating to an offence under Sections 364, 302 and 120B/34 of the I.P.C. taking into consideration that on the confessional statement of the petitioner the dead body of the deceased was recovered. In the said confessional statement, the petitioner had accepted his guilt. A report was called for from the court below. It has

No.18170 of 2017 (3) dt.17-05-2017 2/2 been reported that out of 13 prosecution witnesses 4 prosecution witnesses have already been examined and the trial is expected to be concluded within a period of twelve months. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to take all necessary steps to conclude the trial within a period of twelve months from the date of receipt/production of a copy of this order.

The District Magistrate, Jamui and the Superintendent of Police, Jamui are also directed to take necessary steps to produce the witnesses on the date fixed in the Trial Court so that the trial could be concluded within the stipulated period.
