NILU AGRAWAL ORAL ORDER (Per: HONOURABLE MR. JUSTICE AJAY KUMAR TRIPATHI) 08-01-2018 Delay of 96 days is condoned. I.A. No.2067 of 2017 is allowed. The matter is thereafter taken up on merits. Since the learned Single Judge has dismissed the writ application vide order dated 29.08.2016 refusing to interfere with the order of rejection of grant of compassionate appointment, the appeal has been preferred.

Bereft of the finding given by the learned Single Judge with regard to educational certificates provided by the appellant, one of which turned out to be fake and the other one being genuine has no meaning since the passing of Standard 8 was

Patna High Court LPA No.2339 of 2016(3) dt.08-01-2018 2/2 doubtful. Even otherwise, since the death of the employee happened in the year 2003, the object of compassionate appointment has been lost out in the last decade and half. Appeal has no merit. It is dismissed.
