JUSTICE BIRENDRA KUMAR ORAL ORDER 11-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 3/4 of the Dain Act.
Allegation against the petitioner is to have assaulted to the wife of the informant alleging that she is a witch and had played witchcraft on the daughter of Sukhdeo Paswan. Submission of the petitioner is that general and omnibus allegation is there and similarly situated some other coaccused, namely, Pintu Kumar and Balkeshwar Paswan and others have already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.53603 of 2016 and Cr. Misc. No.50713

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sherghati, Gaya/Successor Court, in connection with Imamganj P.S. Case No.35 of 2011, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
