No. 195 of 2006 passed by the Munsif, Gopalganj, whereby and whereunder the application dated 16.08.2013, filed by the plaintiff-petitioner has been dismissed.

I do not consider it to be a proper case for being entertained at the said stage of the case before the court below filed under Article 227 of the Constitution of India. In my view, the plea, which is being taken in the present proceeding can be raised by him at appropriate stage.
