This application for grant of regular bail arises out of Cheriya Bariyarpur P.S. Case No. 54 of 2020, disclosing offences punishable under Sections 302,201/34 of the Indian Penal Code.

The First Information Report was registered against three persons. The petitioner's name, however, surfaced during the course of investigation on the basis of confessional statement of co-accused Hakru Paswan.

Learned counsel for the petitioner has submitted that one Sanjay Paswan has also been made an accused on the basis of confessional statement of said co-accused Hakru Paswan,

Patna High Court CR. MISC. No.36241 of 2020(4) dt.09-03-2021 2/2 who has been granted regular bail by this Court by order dated 02.02.2021 passed in Cr. Misc. No. 37485 of 2020. Learned counsel for the informant has opposed the prayer for bail.

I have perused the case diary.

I find substance in the submission made on behalf of the petitioner that there is no material to distinguish the petitioner's case from that of Sanjay Paswan, for the purpose of grant of regular bail.

This application is allowed.

Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Manjhaul, Begusarai in Cheriya Bariyarpur P.S.
