JUSTICE SANJAY PRIYA ORAL ORDER 04-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Section 392 of the Indian Penal Code. It is alleged that on the date of occurrence four miscreants looted money and a mobile phone of the informant and his son and also snatched the key of the motorcycle. Learned counsel for the petitioner submits that the petitioner is not named in the First Information Report and no Test Identification Parade has been held till date. During investigation, his name has come in the confessional statement of co-accused Sawan Kumar. The petitioner is said to be in custody since 28.4.2012.

Learned Sessions Judge in the impugned order has mentioned that the petitioner is in custody since 28.4.2012 and no

Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rosera at Samastipur, in connection with Rosera P.S. Case No. 209 of 2011, subject to the condition that both the bailors will be the close relatives of the petitioner.
