The petitioners seek bail in Motihari (Muffasil) P.S. Case No. 398/2016, registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 47(A) and 30(A) of the Excise Act.

The police raided a lonely place on the information that the petitioners had kept country-made liquor to sell and from there about 40 litres of country-made liquor was recovered. It is submitted that nothing has been recovered from the conscious possession of the petitioners and petitioners are in jail since 04.01.2017. Petitioners have already remained in jail for two

Considering the facts aforesaid, the petitioners abovenamed, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Motihari (Muffasil) P.S. Case No. 398/2016.
