The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 414, 420 of the Indian Penal Code and 11 Gambling Act.

Submission is that on confidential information by the informant with the help of police personnel dated 07.04.2019 at 3.30 P.M. raided near the railway line at Jagdishpur (Sough side) then 10 to 15 persons after seeing police fled away, but one co-accused namely Vikash Kumar Dubey has been arrested by police and he has confessed the all co-accused including the petitioner and also stated that all the co-accused are playing gambling, thereafter informant seized the playing card (Tass), mobile and 4 motorcycles and prepared seizure list.

No.36020 of 2019(3) dt.07-08-2019 2/2 Learned counsel for the petitioner submits that petitioner is man of clean antecedent and quite innocent and has falsely been implicated in this case due to dirty village politics. As per FIR petitioner is not arrested at place of occurrence nor anything recovered from the conscious possession. The coaccused have been granted anticipatory bail by this Coordinate Bench of this Hon'ble Court vide Cr. Misc. No. 36796 of 2019 dated 17.06.2019.

In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Buxar (Muffasil) P.S. Case No. 107 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
