ANJANA MISHRA ORAL ORDER 22-09-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 307 and other sections of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that admittedly there was some altercation between the parties in which both the parties sustained injuries. However, injuries sustained by the persons is said to have been caused by these petitioners, but are simple in nature. It is submitted that during the altercation some members of his family also sustained injuries. Considering the aforementioned facts and circumstances of

No.19173 of 2015 (3) dt.22-09-2015 the case and also there is case and counter case between the parties, let the petitioners, in the event of their arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned SubDivisional Judicial Magistrate, Biraul at Benipur, Darbhanga in connection with Kusheshwar Asthan P.S. Case No. 119/2014 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
