The petitioner seeks bail in Ballia P.S. Case No. 75 of 2019, instituted for the offence under Section(s) 394/411 of the Indian Penal Code.

It is alleged in the written report that while informant was returning to his house after getting the tempo repaired, two boys boarded in tempo of the informant and asked him to proceed to Ballia. It is further alleged that when they reached near Bariyarpur Dhala, both persons asked the informant to stop the vehicle. They snatched the original paper of the vehicle, Mobile Phone and tempo and fled away. They also assaulted the informant.

Counsel for the petitioner submits that petitioner is

Patna High Court CR. MISC. No.36935 of 2019(2) dt.19-06-2019 2/2 not named in the written report. He further submits that during course of searching the vehicle, the same was found with Navin Sharma. The mobile phone of the informant was also found with him without SIM. Petitioner has no concern with the aforesaid articles. Co-accused Navin Sharma during investigation has taken the name of petitioner. Petitioner is in custody since 13.3.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Ballia P.S. Case No. 75 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
