JUSTICE SUDHIR SINGH ORAL ORDER 06-03-2017 Heard learned counsel for the petitioner, the State and the informant.
The petitioner seeks bail in a case instituted for the offences under Sections 498(A), 341, 323 and 504 of the I.P.C. and Sections 3⁄4 of the Dowry Prohibition Act. The prosecution story, in brief, is that the informant was married with the petitioner on 3.3.2015. After marriage the accused persons including the petitioner started demanding cash of Rs.1 lac and due to non-fulfilment of the same they tortured her in various ways and assaulted her on various occasion. They also ousted her from the matrimonial home.
It has been submitted on behalf of the petitioner that
Patna High Court Cr.Misc. No.6859 of 2017 (2) dt.06-03-2017 2/2 the petitioner is in custody since 25.12.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The allegation made in the F.I.R. is denied by him.
On behalf of the State and the learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda at Bihar Sharif in connection with Deepnagar P.S. case No.222 of 2016.
