The petitioner seeks bail in a case instituted under Sections 420, 406, 409 and 34 of the Indian Penal Code. The allegation against the petitioner is that he in collusion with other co-accused misappropriated the government fund showing false and excess number of the students in different schools.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.01.2017. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is a Clerk in the District Welfare Office, Araria. He has been made accused due to mistake of fact. There is no specific
Patna High Court Cr.Misc. No.6916 of 2017 (2) dt.09-03-2017 2/2 allegation of misappropriation of public money against the petitioner. The list of the students for the scholarship was furnished to him by the Headmaster of the respective schools. The other co-accused have been granted anticipatory bail vide Cr. Misc. No. 49976 of 2016, Cr. Misc. No. 53711 of 2016, Cr. Misc. No. 722 of 2017, Cr. Misc. No. 53342 of 2016 and Cr. Misc. No. 54052 of 2016.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Araria in connection with Araria P.S.
