JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with C.R. No. 203 of 2008 registered for the offences punishable under Sections 498A and 379 of the Indian Penal Code. Petitioner happens to be husband of the complainant and according to complain case itself, the marriage of the complainant was solemnized with the petitioner in the year 2003 but after five years of the marriage, the complainant filed the complain case .

It is obvious from perusal of the record that notices

Patna High Court Cr.Misc. No.24769 of 2014 (5) dt.24-03-2015 2/2 were sent to the complainant thrice by this Court but she did not choose to appear before this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Jhanjharpur, Madhubani in C.R. No. 203 of 2008 , subject to condition as laid down under Section 438(2) of the Cr.P.C.
