The Petitioner seeks bail in Sherghati(Dobhi) P.S. Case No. 559 of 2016 instituted for the offence under Section(s) 302, 34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the police after investigation has submitted charge-sheet under Section 306 of the Indian Penal Code. The own son of the deceased has stated in para 6 of the case diary that his mother has committed suicide. The petitioner is husband of the deceased. It is alleged in the written report that petitioner has committed murder of his wife/deceased for non-fulfilment of demand of money to repay installment of tempo.

Learned A.P.P. after going through the case diary has stated that son of the deceased in para 6 and one of the neighbours in para 7 of the case diary have stated that deceased has committed suicide. The investigation has already been completed and the police has found the case true for the offence under Section 306 of the Indian Penal Code.

The petitioner is said to be in custody since 29.11.2016.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Sherghati, Gaya in connection with Sherghati (Dobhi) P.S. Case No. 559 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) Shageer/- U T
