2. The petitioner is apprehending his arrest in connection with Andar P.S Case No. 339 of 2024 dated 12.12.2024 registered for the offence punishable u/ss 329(3), 191(2), 191(3), 190, 118(1), 109 and 352 of the B.N.S.
3. As per the prosecution case, on 12.12.2024, the informant was sitting at his door along with his two sons namely Vikrama Yadav and Ashok Yadav, in the meantime, the petitioner came there with farsa and started assaulting the informant. When the informant's sons came to rescue him, Rajesh Yadav, Sachin Yadav, Abhishek Yadav, Sonu Yadav, Manju Devi, Ram Rikhiya Devi and Priyanka Kumari came
Patna High Court CR. MISC. No.37133 of 2025(2) dt.02-07-2025 2/3 with sharp weapon and assaulted the informant and his sons due to which the informant sustained head injuries. When the informant fell down, the accused persons also assaulted him with lathi and danda. When the informant's wife came to rescue him, she was also assaulted by the accused persons causing injury on her head. They also assaulted the informant's son Manoj Kumr due to which he sustained head and hand injuries. On being raised alarm, the accused persons fled away from the spot. Thereafter, the injured was taken to the hospital for treatment.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is a case and counter case between the parties. Nothing has been recovered from the conscious possession of the petitioner. As per the injury report of the informant Vikrama Yadav, he sustained three injuries and all the injuries are simple in nature caused by hard and blunt susbtance. The petitioner has no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition.
5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.
6. Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.37133 of 2025(2) dt.02-07-2025 3/3 of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Siwan, in connection with Andar P.S Case No. 339 of 2024, subject to conditions as laid down under section 482(2) of the B.N.S.S.
7. The application stands allowed.
