2. The petitioners in this application pray for bail apprehending their arrest in connection with Mansahi P.S. Case
Patna High Court CR. MISC. No.37320 of 2025(3) dt.03-09-2025 2/3 no.49 of 2021 registered for the offence punishable under sections 341, 447, 323, 379, 435, 427, 504, 506 and 34 of the Indian Penal Code and sections 25(1-B) and 27 of the Arms Act.
3. As per the prosecution case, while the informant was in the office, it is stated that the accused persons reached there, assaulted the informant and set his house on fire. They are also said to have taken away Rs.50,000/ and also resorting to firing.
4. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the case. No person was injured in the entire occurrence. It is submitted that there is case and counter case between the parties. In the case lodged against the petitioners, final form was submitted on 16.7.2021, however differing with the same, cognizance was taken on 2.9.2021. Learned counsel further submits that in the case lodged by the petitioner's side, chargesheet was submitted and cognizance was taken on 20.2.2023. The petitioners have no criminal antecedent.
5. The application for bail is opposed by learned A.P.P. for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegation against the petitioners in
Patna High Court CR. MISC. No.37320 of 2025(3) dt.03-09-2025 3/3 the FIR, final form having been submitted in the case against them though cognizance was subsequently taken differing with the same together with the petitioners not having any criminal antecedent, it is directed that all the five petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Mansahi P.S. Case no.49 of 2021 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VI, Katihar.
