====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-07-2026 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of Mines Department.

2. The petitioner apprehends his arrest in a case registered for the offence under Sections 191(1), 191(2), 125, 130, 132, 303(2), 317(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023.

3. As per F.I.R., twelve tractors were seized by the Mines Department at the bank of Keshoria Ghat on the allegation that petitioner and other F.I.R. named accused persons were indulged in illegal mining of sand, causing a loss of 25,49,363/- to the Government.

4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case due to village politics. Petitioner is not the owner of any of the seized tractors and has got no concern with the alleged excavation of sand. However, without accepting his guilt, learned counsel for the petitioner submits that petitioner is ready to pay Rs. 50,000/- to the Mines Department. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Nawada, in connection with Nadriganj P.S. Case No. 130 of 2025, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023 with condition to the petitioner to pay Rs. 50,000/- through demand draft in favour of Mines Supervisor, Nawada / concerned officer of Mines Department, towards the liability fastened by the Mines Department as well as on the following conditions:
