The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 406, 504, 506/34 of the Indian Penal Code and 3(1) (x) of the S.C./S.T.(Prevention of Atrocities) Act. It is alleged that the informant was worked as a labour under the petitioner, but subsequently he stopped work since his due out of wages of Rs. 1,53,000/- only Rs. 26,000/- was paid. On 17.12.2014 the accused persons came to the house of the informant and started abusing by calling caste name.
It is submitted by the learned counsel for the petitioner that in the background of wages dispute the
Patna High Court Cr.Misc. No.19338 of 2015 (2) dt.29-04-2015 accusation has been levelled. Admittedly, the occurrence took place inside the house of the informant, hence it may not be treated to be a place of public view. . For the occurrence of 17.12.2014 the First Information Report was registered on 08.01.2015 and the petitioner is a resident of different District. Considering the delayed lodging of the case and the accusation in the background of wages dispute, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Banka in connection with Banka S.C./S.T. P.S. Case No. 01 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
